TERMS AND CONDITIONS

Article 1: Definitions

The conditions are understood to mean:

  1. Holiday residence: Villa la Pinède

  2. Landlord: The owner of Villa la Pinède who makes the holiday accommodation available;

  3. Holiday maker: the person who enters into the agreement regarding the holiday accommodation with the lessor;

  4. Fellow holiday maker: the persons also specified on the agreement;

  5. Costs: all costs for the landlord associated with the rental of the holiday accommodation;

  6. Information: written/electronic information about the use of the holiday accommodation, the facilities and the company's (house) rules;

  7. Booking amount: total agreed price for the accommodation.

  8. Cancellation: the written termination of the agreement by the holiday maker before the commencement date of the stay

 

Article 2: Content agreement

  1. The lessor makes the holiday accommodation available to the holiday maker for recreational purposes, so not for permanent residence, for the agreed period and the agreed price;

  2. The lessor is obliged to provide the holiday maker with the information on the basis of which this agreement is also concluded in advance. The lessor will always inform the holiday maker of any changes in this by e-mail;

  3. If the information deviates significantly from the information provided when entering into the agreement, the holiday maker has the right to cancel the agreement free of charge;

  4. The holiday maker is obliged to comply with the agreements and the accompanying information. He ensures that fellow holiday maker(s) staying with him comply with the agreement and the associated information;

  5. These general terms and conditions and associated information always apply. This does not alter the fact that the holiday maker and the lessor can make individual additional agreements whereby it is possible to deviate from these conditions in favor of the holiday maker.

 

Article 3: Duration and expiration of the agreement

The agreement ends by operation of law after the expiry of the agreed period, without notice being required.

 

Article 4: Price

The price is agreed on the basis of the rates applicable at that time, which have been determined by the lessor.

 

Article 5: Reservation and payment

  1. The landlord will confirm the reservation to you within 10 days of receipt by e-mail [VvKM(1] and invoice the booking amount. You must check the confirmation, which is also the invoice, for correctness immediately upon receipt. Any or alleged inaccuracies must always be reported by telephone. or to be notified by e-mail;

  2. The holiday maker must make payments in euros, unless otherwise agreed, with due observance of the agreed terms;

  3. The booking amount is invoiced by the lessor to the holiday maker in 2 installments:

    • 50% of the booking amount must be paid by the holiday maker within 14 days of the date of the invoice;

    • The remaining 50% of the booking amount must be in the possession of the lessor no later than 8 weeks before the start of the stay;

    • When booking within 8 weeks before the start of the stay, the entire booking amount must be paid at once upon reservation;

  4. If we have not received the entire amount within the aforementioned period, we are entitled to unilaterally dissolve the agreement two weeks after a reminder by email, and the reservation and any form of refund will lapse.

  5. Your deposit will be refunded, provided there are no costs to be settled, after the final cleaning, by bank or giro;

 

​Article 6: Arrival and departure

On the day of arrival, your holiday accommodation is available from 4 pm. On the day of departure, we ask you to leave your holiday accommodation before 10.00 am for the final cleaning and the arrival of the new guests.

 

Article 7: Cancellation

In the event of cancellation, the holiday maker pays a fee to the lessor. This amounts to:

  1. In case of cancellation more than 8 weeks before the start of the stay, 50% of the booking amount is due.

  2. If canceled within 8 weeks before the start of the stay, the full booking amount is due.

  3. In the event of premature termination of the stay, the full booking amount is due

We advise you to take out cancellation insurance.

  1. In the event of force majeure or non-culpable calamities, no refund is possible by the lessor.

Article 8: Internal regulations

  1. You will receive the House Rules upon arrival.

  2. Violation of the House Rules can result in removal from Villa la Pinède, without refund of the booking amount or part thereof. 

 

Article 9: Laws and regulations

  1. The company ensures at all times that the holiday accommodation, both internally and externally, meets the environmental and safety requirements that (may) be set by the government for the holiday accommodation.

  2. The holiday maker is obliged to strictly comply with all safety regulations applicable on the site. He also ensures that fellow holidaymakers and third parties who visit him strictly comply with these safety regulations.
     

Article 10: Maintenance and construction

  1. The lessor is obliged to keep the recreation area and the central facility in a good state of repair;

  2. During the term of the agreement, the holiday maker is obliged to keep the holiday accommodation and the immediate surroundings in the same condition as in which the holiday maker received it.
     

Article 11: Liability

  1. The legal liability of the lessor is limited to a maximum of the amount stated in the corporate liability insurance/policy taken out by the lessor.

  2. The lessor is not liable for an accident, theft or damage on his premises, unless this is the result of a shortcoming attributable to the lessor;

  3. The lessor is not liable for the consequences of extreme weather conditions or other forms of force majeure;

  4. The landlord is not liable for failures in the utilities.

  5. The holiday maker is liable towards the lessor for damage caused by the acts or omissions of himself, fellow holiday maker or third parties, insofar as it concerns damage suffered by the holiday maker, fellow holiday maker and/or third parties. can be attributed.

  6. The lessor undertakes to take appropriate measures after the holiday maker has reported nuisance caused by other holidaymakers.
